Terms of Service
Last updated: 15 October 2026
1. The service
ActPrism (operated by Eric Phan) prepares written EU AI Act readiness assessments ("Reports") based on information you provide through our intake questionnaire. The scope, number of AI systems covered, revision rounds and delivery time for each tier (Risk Snapshot, Standard Assessment, Full Assessment) are as described on our website or agreed in writing when you order.
2. Your responsibilities
- Provide accurate, complete and current information. Reports rely on what you tell us; we do not audit your systems, code or data.
- Make sure you have the right to share any materials you send us.
- Make your own compliance decisions, ideally with qualified legal counsel.
3. Delivery
Delivery times are in business days and start when we receive a complete intake. If we need clarification, the clock pauses until you reply.
4. Fees and payment
Prices are fixed per tier, in USD, and exclude any applicable taxes. Payment is due before work begins unless agreed otherwise.
5. Refunds
- Late delivery: if we miss the delivery time for your tier (counted from a complete intake), you get a full refund on request, and you keep the Report when it arrives.
- Before intake: if you cancel before submitting the intake, you get a full refund.
- Once a Report has been delivered on time, fees are non-refundable, but revision rounds included in your tier remain available.
6. Re-assessments
If your AI systems change, a re-assessment ordered within 12 months of your original Report costs 50% of your original tier price, with the same scope and timelines.
7. Use of Reports
You may use and share your Report within your organisation and with your advisers, investors and customers. You may quote our customer-facing position statement. You may not describe a Report as legal advice, a certification, or proof of compliance, or imply that ActPrism has certified your product. Our templates and methodology stay ours.
8. Accuracy and regulatory change
Each Report reflects Regulation (EU) 2024/1689 (as amended, including by Regulation (EU) 2026/1744) and publicly available guidance on its date. Implementing acts, standards, guidelines and court or regulator interpretations may change how the law applies. We don't promise to update delivered Reports.
9. Confidentiality and data
We keep your materials confidential and handle personal data as described in our Privacy Policy. We will sign a reasonable NDA on request.
10. Limitation of liability
Reports are provided "as is" for informational purposes. To the fullest extent the law allows, we are not liable for any indirect or consequential loss, or for regulatory fines, penalties or decisions you make based on a Report. Our total liability for any claim is limited to the fees you paid for the Report concerned. Nothing in these terms limits liability that cannot legally be limited.
11. Governing law
These terms are governed by the laws of the Yukon and the federal laws of Canada that apply there, unless mandatory law in your jurisdiction says otherwise.
